Terms and Conditions

Please read these terms and conditions carefully before using our service.
1. DEFINITIONS
For the purposes of these Terms and Conditions:

Affiliate means an entity that controls, is controlled by
or is under common control with a party, where "control"
means ownership of 50% or more of the shares, equity
interest or other securities entitled to vote for election
of directors or other managing authority.

Carrier Company means a registered business entity that operates commercial vehicles and manages drivers on the Platform.

Company (referred to as either "the Company", "We", "Us" or
"Our" in this Agreement) refers to Bikum UAE.

Country refers to: United Arab Emirates

Device means any device that can access the Service such as
a computer, a cellphone or a digital tablet.

Driver means an individual registered user who operates commercial vehicles and accepts transportation jobs through the Platform.

Load means freight, cargo, or goods posted by Shippers for transportation.

Platform refers to the Bikum service including the Website, mobile applications, and all related services.

Quotation means a bid or price proposal submitted by Carriers or Drivers for transporting a Load.

Service refers to the Website and mobile applications.
-
Shipper means a registered user who posts Loads for transportation.

Subscription means the paid access plan for Carriers and Drivers to access the Platform's truck registration features.

Terms and Conditions (also referred as "Terms") mean these
Terms and Conditions that form the entire agreement between
You and the Company regarding the use of the Service.

Third-party Social Media Service means any services or
content (including data, information, products or services)
provided by a third-party that may be displayed, included
or made available by the Service.

Website refers to Bikum UAE, accessible from
https://www.bikum.org/

You means the individual accessing or using the Service, or
the company, or other legal entity on behalf of which such
individual is accessing or using the Service, as
applicable.
2. ACKNOWLEDGEMENT
These are the Terms and Conditions governing the use of this
Service and the agreement that operates between You and the
Company. These Terms and Conditions set out the rights and
obligations of all users regarding the use of the Service.
Your access to and use of the Service is conditioned on Your
acceptance of and compliance with these Terms and Conditions. These
Terms and Conditions apply to all visitors, users and others who
access or use the Service.
By accessing or using the Service You agree to be bound by these
Terms and Conditions. If You disagree with any part of these Terms
and Conditions then You may not access the Service.
You represent that you are over the age of 18. The Company does not
permit those under 18 to use the Service.
Your access to and use of the Service is also conditioned on Your
acceptance of and compliance with the Privacy Policy of the
Company. Our Privacy Policy describes Our policies and procedures
on the collection, use and disclosure of Your personal information
when You use the Application or the Website and tells You about
Your privacy rights and how the law protects You. Please read Our
Privacy Policy carefully before using Our Service.
3. USER REGISTRATION AND ACCOUNTS
3.1 Account Creation
To access certain features of the Platform, You must register for an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update Your account information
- Maintain the security of Your password and account credentials
- Notify Us immediately of any unauthorized use of Your account
- Accept responsibility for all activities that occur under Your account
3.2 User Types
The Platform supports three distinct user types:
- Shippers: May register via Website or mobile application
- Carrier Companies: Must register via Website only
- Individual Drivers: Must register via mobile application only
3.3 Verification Requirements
You may be required to provide:
- Valid identification documents
- Business registration documents (for Carrier Companies)
- Vehicle registration and insurance documents (for Drivers and Carriers)
- UAE traffic file numbers for commercial vehicles
- Bank account information for payment processing
- Any other documentation reasonably requested by the Company
3.4 Account Suspension
The Company reserves the right to suspend or restrict Your account if:
- You violate these Terms and Conditions
- You provide false or misleading information
- Your account activity appears suspicious or fraudulent
- You fail to maintain required documentation
- Payment obligations are not met
4. SUBSCRIPTION SERVICES
4.1 Subscription Plans
Access to truck registration features requires a paid Subscription:
- 180-day Subscription: 600 AED per truck
- 360-day Subscription: 1,000 AED per truck
4.2 Subscription Terms
- Subscriptions are per vehicle/truck registration
- Payment must be received before Subscription activation
- Subscriptions are non-transferable between vehicles
- Free registration is provided for Shippers and basic Carrier/Driver accounts
4.3 Automatic Renewal
Subscriptions do not automatically renew. You must manually renew Your Subscription before expiration to maintain access to truck registration features.
4.4 Refund Policy
Subscription fees are non-refundable except:
- Where required by applicable law
- In cases of significant service disruption caused by the Company
- At the Company's sole discretion in exceptional circumstances
4.5 Changes to Subscription Fees
The Company reserves the right to change Subscription fees and duration without prior notification. New pricing will apply upon subscription renewal and will not affect active Subscriptions until their expiration.
4.6 Trial Period
The Company may offer trial periods at its discretion. The Company reserves the right to reduce or extend trial periods without notification.
4.7 Subscription Cancellation
The Company reserves the right to suspend or cancel any Subscription without notification, compensation, or justification.
5.1 Shipper Obligations
As a Shipper, You agree to:
- Provide accurate Load details including weight, dimensions, origin, and destination
- Ensure Loads comply with UAE transportation regulations
- Provide safe and legal cargo for transportation
- Be available for communication regarding posted Loads
- Make payment prior to accepting any Quotation
- Accept or reject Quotations in a timely manner
5.2 Carrier and Driver Obligations
As a Carrier or Driver, You agree to:
- Maintain valid commercial driver licenses and vehicle registrations
- Ensure vehicles meet UAE safety and regulatory standards
- Provide accurate vehicle information including capacity and availability
- Submit fair and accurate Quotations
- Honor accepted Quotations and complete jobs professionally
- Maintain adequate insurance coverage
- Comply with all UAE traffic and commercial transportation laws
- Accept full responsibility for any impact, damage, or issue caused to Load materials during transportation, loading, or unloading
- Commit to fulfill and deliver the Load by the agreed drop-off date and time as stated in the accepted Quotation
- Ensure vehicles are covered by adequate insurance to compensate the Shipper or Bikum for any damage to Load materials caused by the Carrier/Driver or their negligence
- Compensate for delays in delivering the Load beyond the agreed drop-off date, unless caused by force majeure events or circumstances beyond reasonable control
5.3 Prohibited Activities
You may not:
- Use the Platform for illegal purposes
- Post or transport prohibited or restricted goods without proper authorization
- Manipulate pricing or engage in price fixing
- Create multiple accounts to circumvent Platform rules
- Harass, threaten, or defraud other users
- Attempt to bypass the Platform to avoid fees or commissions
- Share account credentials with unauthorized parties
- Scrape, copy, or misuse Platform data
- Interfere with the Platform's operation or security
6. QUOTATIONS AND TRANSACTIONS
6.1 Quotation Process
- Drivers and Carriers may submit Quotations for posted Loads
- Quotations represent binding offers when submitted
- Shippers may accept or reject Quotations at their discretion
- Upon acceptance, a binding agreement is formed between Shipper and Carrier/Driver
6.2 Payment Terms
- Payment must be made by Shippers prior to accepting any Quotation
- The Company holds funds during transportation
- Funds are released to Carriers/Drivers upon successful delivery confirmation and within 10 working days, provided there are no open or unresolved complaints that prevent release
- The Company deducts applicable commission fees before fund release
6.3 Commission Fees
The Company charges commission fees on completed transactions. Current commission rates are available on the Platform and may be updated at the Company's discretion with reasonable notice.
6.4 Cancellation Policy
- Cancellations after Quotation acceptance may result in penalties
- Valid reasons for cancellation include safety concerns or force majeure events
- Repeat cancellations may result in account suspension
- Cancellation fees may apply as determined by the Company
6.5 Disputes and Chargebacks
- Users must attempt to resolve transaction disputes directly first
- Shippers may file complaints regarding delivery issues, damage, or service quality
- Open complaints will prevent fund release to Carriers/Drivers until resolved
- The Company will investigate complaints and may hold funds for up to 30 days during investigation
- If a complaint is found valid, funds may be refunded to the Shipper or held as compensation
- If a complaint is found invalid or unsubstantiated, funds will be released to the Carrier/Driver
- Disputed funds may be held until resolution
- The Company may mediate disputes but is not obligated to do so
- Fraudulent chargeback attempts may result in account termination
- Repeat or frivolous complaints may result in account warnings or suspension
7. PAYMENT PROCESSING
7.1 Payment Methods
The Platform accepts payment methods as displayed during the payment process. You agree to provide valid payment information and authorize charges for Services used.
7.2 Payment Security
While We implement security measures, You are responsible for:
- Keeping payment credentials secure
- Reviewing transaction records for unauthorized activity
- Promptly reporting suspicious transactions
7.3 Bank Account Information
Carriers and Drivers must provide valid UAE bank account information (including IBAN) to receive payments. The Company is not responsible for delays or failures due to incorrect banking information.
7.4 Tax Obligations
You are solely responsible for determining and paying any applicable taxes on income earned or fees paid through the Platform.
8. INTELLECTUAL PROPERTY RIGHTS
8.1 Company Property
The Platform, including its design, code, logos, trademarks, and content, is owned by the Company and protected by intellectual property laws. You may not:
- Copy, modify, or distribute Platform content without permission
- Use Company trademarks or branding without authorization
- Reverse engineer or attempt to extract source code
- Create derivative works based on the Platform
8.2 User Content
You retain ownership of content You submit to the Platform but grant the Company a worldwide, non-exclusive, royalty-free license to use, display, and distribute such content for Platform operation and improvement.
8.3 Feedback
Any suggestions, ideas, or feedback You provide may be used by the Company without compensation or attribution.
9. DATA PROTECTION AND PRIVACY
9.1 Personal Data
Your use of the Platform involves the collection and processing of personal data as described in Our Privacy Policy. By using the Service, You consent to such processing.
9.2 Location Data
The Platform collects real-time location data from Drivers and vehicles to facilitate tracking and service delivery. You consent to this collection when using Driver features.
9.3 Data Accuracy
You are responsible for ensuring all data You provide is accurate and up-to-date. The Company is not liable for issues arising from inaccurate user-provided data.
10. LIABILITY AND INDEMNIFICATION
10.1 Limitation of Liability
To the maximum extent permitted by UAE law:
- The Company is not liable for indirect, incidental, special, or consequential damages
- Our total liability shall not exceed the fees paid by You in the 12 months preceding the claim
- We are not liable for loss of profits, data, or business opportunities
10.2 Service Limitations
The Company:
- Acts only as an intermediary connecting Shippers with Carriers/Drivers
- Does not provide transportation services directly
- Is not responsible for the actions or omissions of platform users
- Does not guarantee Load delivery, vehicle availability, or service quality
- Is not liable for damage to cargo, vehicles, or property during transportation
10.3 User Indemnification
You agree to indemnify and hold harmless the Company, its affiliates, officers, directors, and employees from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your violation of these Terms
- Your use of the Platform
- Your interactions with other users
- Transportation services You provide or receive
- Any negligent or wrongful conduct
10.4 Insurance Requirements
Carriers and Drivers are solely responsible for obtaining and maintaining adequate insurance coverage including:
- Commercial vehicle insurance
- Cargo insurance with sufficient coverage to compensate Shippers for full value of transported goods
- Liability insurance covering damage to Load materials during transportation
- Any other insurance required by UAE law
Carriers and Drivers must ensure their insurance policies cover:
- Damage to cargo caused by accidents, negligence, or improper handling
- Compensation to Shippers for damaged or lost Load materials
- Compensation to Bikum for any liabilities arising from cargo damage claims
- Delays in delivery that result in financial losses to Shippers
The Company does not provide insurance coverage and is not responsible for insurance-related issues. Carriers and Drivers who fail to maintain adequate insurance may have their accounts suspended or terminated.
11. DISPUTES BETWEEN WEBSITE USERS
The Company's role is restricted to connecting Shippers with Carriers and Drivers. The Company:
- Has no responsibility toward disputes between platform users
- Does not guarantee the performance or reliability of any user
- Is not a party to transportation agreements between users
- May, at its discretion, provide mediation assistance but is not obligated to do so
Users are encouraged to resolve disputes directly and may seek legal recourse through appropriate UAE courts if necessary.
12. FORCE MAJEURE
The Company shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to:
- Acts of God, natural disasters, or severe weather
- War, terrorism, or civil unrest
- Government actions, laws, or regulations
- Internet or telecommunications failures
- Cyberattacks or security breaches
- Pandemics or public health emergencies
13. TERMINATION
13.1 Termination by Company
The Company reserves the right to terminate any account without notification and without providing justification. Reasons may include but are not limited to:
- Violation of these Terms
- Fraudulent activity
- Abusive behavior toward other users
- Non-payment of fees
- Prolonged inactivity
13.2 Termination by User
You may terminate Your account at any time by contacting the Company. Termination does not entitle You to refunds for unused Subscription periods unless required by law.
13.3 Effects of Termination
Upon termination:
- Your access to the Platform will be revoked
- Outstanding payment obligations remain due
- Pending transactions may be completed or cancelled at Company discretion
- Your data may be retained as required by law or Company policy
14. "AS IS" AND "AS AVAILABLE" DISCLAIMER
The Service is provided to You "AS IS" and "AS AVAILABLE" and with
all faults and defects without warranty of any kind. To the maximum
extent permitted under applicable law, the Company, on its own
behalf and on behalf of its Affiliates and its and their respective
licensors and service providers, expressly disclaims all
warranties, whether express, implied, statutory or otherwise, with
respect to the Service, including all implied warranties of
merchantability, fitness for a particular purpose, title and
non-infringement, and warranties that may arise out of course of
dealing, course of performance, usage or trade practice.
Without limitation to the foregoing, the Company provides no warranty or
undertaking, and makes no representation of any kind that the
Service will meet Your requirements, achieve any intended results,
be compatible or work with any other software, applications,
systems or services, operate without interruption, meet any
performance or reliability standards or be error free or that any
errors or defects can or will be corrected.
Without limiting the foregoing, neither the Company nor any of the
company's provider makes any representation or warranty of any
kind, express or implied: (i) as to the operation or availability
of the Service, or the information, content, and materials or
products included thereon; (ii) that the Service will be
uninterrupted or error-free; (iii) as to the accuracy, reliability,
or currency of any information or content provided through the
Service; or (iv) that the Service, its servers, the content, or
e-mails sent from or on behalf of the Company are free of viruses,
scripts, trojan horses, worms, malware, timebombs or other harmful
components.
Some jurisdictions do not allow the exclusion of certain types of
warranties or limitations on applicable statutory rights of a
consumer, so some or all of the above exclusions and limitations
may not apply to You. But in such a case the exclusions and
limitations set forth in this section shall be applied to the
greatest extent enforceable under applicable law.
15. THIRD-PARTY SERVICES
The Platform may contain links to third-party websites or services. The Company:
- Does not endorse or control third-party services
- Is not responsible for third-party content or practices
- Is not liable for any damages arising from third-party interactions
Your use of third-party services is at Your own risk and subject to their terms and conditions.
16. GOVERNING LAW
The laws of the United Arab Emirates, excluding its conflicts of law rules,
shall govern these Terms and Your use of the Service. Your use of
the Platform may also be subject to other local, state,
national, or international laws.
17. DISPUTE RESOLUTION
17.1 Informal Resolution
If You have any concern or dispute about the Service, You agree to
first try to resolve the dispute informally by contacting the
Company at contact@bikum.org.
17.2 Jurisdiction
Any legal action or proceeding arising from these Terms shall be brought exclusively in the courts of the United Arab Emirates, and You consent to the jurisdiction of such courts.
17.3 Arbitration
The Company may, at its discretion, require disputes to be resolved through binding arbitration in accordance with UAE arbitration laws.
18. GENERAL PROVISIONS
18.1 Severability
If any provision of these Terms is held to be unenforceable or
invalid, such provision will be changed and interpreted to
accomplish the objectives of such provision to the greatest extent
possible under applicable law and the remaining provisions will
continue in full force and effect.
18.2 Waiver
Except as provided herein, the failure to exercise a right or to
require performance of an obligation under these Terms shall not
affect a party's ability to exercise such right or require such
performance at any time thereafter nor shall the waiver of a
breach constitute a waiver of any subsequent breach.
18.3 Assignment
You may not assign or transfer these Terms or Your account without the Company's prior written consent. The Company may assign these Terms without restriction.
18.4 Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between You and the Company regarding the Service and supersede all prior agreements and understandings.
18.5 Translation Interpretation
These Terms and Conditions may have been translated if We have made
them available to You on our Service. You agree that the original
English text shall prevail in the case of a dispute.
18.6 Notices
All notices to the Company should be sent to contact@bikum.org. The Company may provide notices to You via email or through the Platform.
19. CHANGES TO THESE TERMS AND CONDITIONS
We reserve the right, at Our sole discretion, to modify or replace
these Terms at any time. If a revision is material We will make
reasonable efforts to provide at least 30 days' notice prior to any
new terms taking effect. What constitutes a material change will be
determined at Our sole discretion.
By continuing to access or use Our Service after those revisions
become effective, You agree to be bound by the revised terms. If
You do not agree to the new terms, in whole or in part, please stop
using the website and the Service.
